Terms and Conditions

By accessing or using WhaleTraders KE ("Platform", "we", "us", or "our"), creating an account, depositing funds, or placing any trade, you ("User", "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use this Platform.

These Terms constitute a legally binding agreement between you and WhaleTraders KE. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

WhaleTraders KE is a binary prediction platform operating in Kenya that allows users to predict whether the price of a given financial instrument (synthetic indices, cryptocurrencies) will rise or fall within a fixed time period.

WhaleTraders KE is not a licensed broker, investment adviser, financial institution, or regulated financial services provider. The Platform does not offer investment products and does not provide financial, investment, tax, or legal advice. All predictions and trades are speculative in nature.

Synthetic indices offered on this Platform are simulated assets whose prices are derived from random number generators or algorithmic models and are not tied to real-world financial instruments.

To use this Platform, you must:

• Be at least 18 years of age.
• Be a resident of or physically located in Kenya (or a jurisdiction where such activity is not prohibited).
• Have the legal capacity to enter into binding contracts.
• Not be accessing the Platform from a jurisdiction where binary options trading is explicitly prohibited.

By registering, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to request proof of age or identity at any time and to suspend accounts where eligibility cannot be confirmed.

You must create an account to use the trading features of the Platform. You agree to:

• Provide accurate, complete, and up-to-date information during registration.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

Each user is permitted to maintain one account only. Creating multiple accounts to circumvent limits, abuse bonuses, or manipulate the Platform is strictly prohibited and will result in immediate termination of all associated accounts and forfeiture of any balances.

Deposits are processed exclusively via M-Pesa(Safaricom). The minimum deposit is KES 10 and the maximum is KES 150,000 per transaction.

Deposits are credited to your trading wallet upon successful M-Pesa confirmation. All deposits are non-refundable once credited to your wallet. If a payment fails before crediting, you will not be charged.

Deposited funds are subject to a 7-day lock periodbefore they become withdrawable as principal. However, trading profits earned on deposited funds become withdrawable immediately, subject to wagering requirements.

We reserve the right to reject, suspend, or reverse deposits suspected of originating from fraudulent, criminal, or money-laundering activity.

When placing a trade, you predict whether an asset's price will be higher (RISE) or lower (FALL) at the expiry time. A correct prediction results in a fixed payout of 105% of the trade amount (a 5% net profit). An incorrect prediction results in the loss of the full trade amount.

Trade parameters:

• Minimum trade: KES 10
• Maximum trade: KES 100,000
• Expiry times: 30 seconds, 1 minute, 2 minutes, 5 minutes
• Maximum trade duration: 5 minutes

Trades are final once placed and cannot be cancelled or modified. Trade outcomes are determined solely by the live market price at expiry and are not subject to negotiation or dispute on grounds of market movement.

In the event of a technical error, system failure, or incorrect price feed at the time of trade placement or resolution, we reserve the right to void affected trades and refund the trade amount to the user's wallet.

You may withdraw trading profits to your M-Pesa number subject to the following conditions:

• Wagering requirement: You must trade at least 3× your total deposited amount before any withdrawal is permitted.
• 50% cap: Each withdrawal is limited to a maximum of 50% of your available withdrawable profits.
• Minimum balance: A minimum balance of KES 100 must remain in your wallet after withdrawal.
• 24-hour cooldown: Only one withdrawal is permitted per 24-hour period.
• Platform fee: A 5% fee is deducted from each withdrawal amount.
• Withdrawal amount range: KES 10 – KES 150,000.

Withdrawals are processed via M-Pesa B2C and typically arrive within minutes, subject to Safaricom processing times. We do not guarantee delivery timelines but will process all valid withdrawal requests promptly.

The following activities are strictly prohibited and will result in immediate account termination and forfeiture of all balances:

• Creating multiple accounts or using fake identity information.
• Using automated bots, scripts, or software to place trades.
• Attempting to manipulate trade outcomes, price feeds, or platform systems.
• Initiating chargebacks or payment disputes for funds already credited to your wallet.
• Using the Platform for money laundering, fraud, or any illegal activity.
• Exploiting bugs, glitches, or system errors for financial gain.
• Sharing account credentials or allowing others to use your account.
• Using VPNs or proxies to circumvent geographic restrictions or rate limits.

All content on this Platform, including but not limited to software, design, graphics, logos, and trademarks, is the exclusive property of WhaleTraders KE and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

To the maximum extent permitted by applicable law, WhaleTraders KE, its operators, and affiliates shall not be liable for:

• Any direct, indirect, incidental, or consequential financial losses arising from trading.
• Technical failures, server downtime, or internet connectivity issues.
• Delays in M-Pesa deposit crediting or withdrawal processing caused by Safaricom.
• Losses resulting from unauthorized access to your account due to your negligence.
• Changes in the value of simulated assets.

Your sole remedy for dissatisfaction with the Platform is to stop using it.

We reserve the right to suspend, restrict, or permanently close any account at our sole discretion, with or without notice, for reasons including but not limited to:

• Violation of these Terms.
• Suspected fraudulent, illegal, or abusive activity.
• Extended inactivity (accounts idle for more than 12 months may be archived).
• Regulatory or legal requirements.

Upon termination for cause, we reserve the right to withhold any balances pending investigation. For terminations not related to misconduct, any remaining withdrawable balance will be paid to your registered M-Pesa number within 14 business days.

Your use of this Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kenya. We encourage users to contact us first to resolve any disputes amicably.
